Abstract (Abstrak)

RYAN TIMOTIUS DJIM (B011221084) INTERNATIONAL LEGAL REVIEW OF HUMANITARIAN ACCESS TO GAZA IN SITUATIONS OF ARMED CONFLICT”. Supervised by Prof. Dr. Judhariksawan S.H., M.H as Supervisor. Background: Armed conflict in the Gaza Strip has resulted in a prolonged humanitarian crisis, causing severe suffering for civilians and limiting access to humanitarian assistance. International humanitarian law and international human rights law regulate the obligation of parties involved in armed conflict to ensure humanitarian access and protect civilian populations during wartime. Objectives: This research aims to analyze how international law reviews humanitarian access to Gaza in situations of armed conflict and to examine the legal obligations of states and international actors in guaranteeing humanitarian assistance for civilians affected by the conflict. Method: This research uses normative legal research methods by compiling research through statutory, conceptual, and case approaches. The types and sources of legal materials used in this study are primary and secondary legal materials. The method used to collect those legal materials is by using literature research method then analysed by using descriptive method. Results: The study shows that (1) international humanitarian law, particularly the Geneva Conventions and customary international law, obligates parties to armed conflict to allow and facilitate rapid and unimpeded humanitarian access for civilians in Gaza; (2) restrictions and blockades that hinder humanitarian assistance may constitute violations of international law when they threaten civilian survival and fundamental human rights. International organizations and the international community have an important role in monitoring, ensuring accountability, and encouraging compliance with humanitarian principles. This research emphasizes the importance of strengthening international cooperation, legal enforcement, and humanitarian protection mechanisms to safeguard civilians during armed conflict. Conclusion: This research emphasizes the importance of international humanitarian law in guaranteeing humanitarian access during armed conflict. The role of states, international organizations, and the international community is essential through strengthening legal protection, international cooperation, and effective monitoring in order to uphold humanitarian principles and protect civilian rights in Gaza.
