Abstract (Abstrak)
M BINTANG FAHREZA TRINANDA (B011211391), with the title "Liability for sexual violence committed by the ambassador of the Republic of Indonesia in Nigeria from the aspect of international law." Under the guidance of Kadarudin as the Main Supervisor. Background: This study aims to determine the legal regulations related to Indonesian ambassadors involved in sexual violence cases from an international law perspective and the application of the sending country's laws in handling sexual violence cases from an international law perspective. Objective: To analyze the provisions related to Indonesian ambassadors involved in sexual violence cases and the application of the sending country's laws in handling sexual violence cases. Method: This study applies normative research using a legislative approach and then processed normatively. Results: In analyzing this study, the author found the following results: (1) If diplomatic representatives fulfill the requirements or commit acts that are considered detrimental to the receiving country, the receiving country may grant them persona non grata status. The receiving country has the right to expel its diplomatic officials in a disrespectful manner for abusing their rights. (2) Full diplomatic immunity under Article 31 of the Vienna Convention protects diplomats from the jurisdiction of the host country, but as Indonesian citizens, they are still subject to national laws such as the TPKS Law. Conclusion: Ambassadors and diplomats are regulated by the Vienna Convention. Individual responsibility in cases of sexual violence occurring in extraterritorial areas such as embassies. Full diplomatic immunity under Article 31 of the Vienna Convention protects diplomats from the jurisdiction of the host country, but as Indonesian citizens, they remain subject to national laws such as the TPKS Law.
