Abstract (Abstrak)

DYANDRA RAYYANI HENDRA PUTRI (B011221156). AN INTERNATIONAL HUMAN RIGHTS PERSPECTIVE ON PROSECUTING RODRIGO DUTERTE BY ICC FOR CRIMES AGAINTS HUMANITY IN PHILLIPINES. Supervised by Iin Karita Sakharina, as Supervisor. Background: The Philippines “war on drugs” has sparked serious human rights abuse allegations that prompted the ICC to launch an investigation, but Duterte’s prosecution faces jurisdictional disputes following the country’s withdrawal from the Rome Statute and its refusal to cooperate. This situation raises questions about the prosecution’s consistency with international human rights principles and highlights the legal-political obstacles that hinder the ICC in enforcing states’ international obligations and protecting human rights. Method: This research uses a normative legal research method. Result: In terms of temporal jurisdiction, the ICC remains competent to examine acts committed while the Philippines was still a State Party to the Rome Statute; therefore, the country’s withdrawal in 2019 does not remove its legal responsibility for acts committed before that date. The main challenges faced by the ICC are procedural and jurisdictional in nature, including the lack of a direct enforcement mechanism and the absence of cooperation from the Philippine government after its withdrawal. Political resistance also complicates the application of ICC authority. Conclusion: The ICC remains legally competent to prosecute alleged crimes committed in the Philippines prior to its withdrawal from the Rome Statute, preserving the country’s accountability for past violations. Nonetheless, the Court’s efforts are hindered by procedural constraints, lack of state cooperation, and political resistance, which collectively limit the effective enforcement of international human rights obligations.
