Abstract (Abstrak)

M. Fadli Amdika Marwan (B011181512), “LEGAL ANALYISIS OF EMPLOYMENT CONTRACTS BETWEEN WORKERS AND EMPLOYERS IN TRADE BUSINESS IN MAKASSAR CITY” under the guidance of Sakka Pati as the main mentor and A. Suci Wahyuni as companion mentor. This study aims to examine the legal relationship in employment agreements between workers and employers in sole proprietorships (Usaha Dagang/UD) in Makassar City, as well as to assess the validity of such employment agreements under the prevailing labor laws. This is an empirical legal research using a sociological legal approach. The data used consist of primary and secondary legal materials, which are analyzed qualitatively.. The results of this study are as follows: (1) All Sole Proprietorships (Usaha Dagang/UD) examined have a legally valid employment relationship with their workers, as they fulfill the elements of employment as regulated in Article 1 point 15 of the Manpower Law, namely the elements of work, command, and wages. (2) All UD entities studied meet the legal requirements of a valid employment agreement as stipulated in Article 52 paragraph (1) of the Manpower Law. However, most of these agreements are made orally without appointment letters, as required under Article 63 paragraph (1), which constitutes an administrative violation. Nevertheless, this does not invalidate the employment relationship, as long as the elements and legal requirements of the agreement are fulfilled. Therefore, the employment agreements remain legally valid, although improved compliance with administrative obligations is necessary.
