Abstract (Abstrak)

Background. The principle of equality guarantees that all individuals, regardless of their differences, are entitled to the same rights and opportunities. Objectives. This research aims to ensuring equal access to jobs, fair treatment, and reasonable accommodations. Both Indonesia and Malaysia have enacted laws to protect the rights of PWDs in employment, aiming to create an inclusive and equitable work environment. Method. This research is normative research conducted by examining various formal legal rules such as laws, regulations, international conventions, and literature containing theoretical concepts that are then linked to the issues to be discussed in this study. Results. The results of this study indicate that: (1) there are several differences of the law and the interpretation of legal words in both Indonesia and Malaysian law; (2) both Indonesia and Malaysia have issues regarding PWD empowerment. Conclusion. Both Indonesia and Malaysia have inadequacies in the implementation of the workers' right to equality principle ranging from debriefing to access to employment.
