Abstract (Abstrak)
Background. Iran launched several drones to attack Israel, with the drones passing over several neighboring countries, including Jordan, where Jordan shot them down. Aims. This research aims to review the rules of international air law regarding the shooting down of State aircraft and liability for such losses. Method. This research is normative research conducted by examining various formal legal rules such as laws, regulations, international conventions, and literature containing theoretical concepts that are then linked to the issues to be discussed in this study. Results. The results of this study indicate that: (1) Jordan's shooting down of an Iranian drone was justified by international air law, as Article 1 of the Chicago Convention affirms a state's sovereignty over its airspace. The Iranian drone, which was a state military aircraft, posed a potential threat to commercial flights in Jordanian airspace, which justified Jordan's defensive action; (2) Iran can seek compensation from Jordan under Article 84 of the Chicago Convention on dispute settlement. However, winning the case is unlikely, as Iran violated Article 3(c) by not obtaining prior permission from Jordan to enter its airspace.
