PELECEHAN SEKSUAL ANAK DI PLATFORM DIGITAL BERDASARKAN KONVENSI HAK ANAK = CHILD SEXUAL ABUSE IN DIGITAL PLATFORM BASED ON CONVENTION ON THE RIGHTS OF THE CHILD

Background. The child sexual abuse in digital platform occurs in June 2024. Perpetrator is victim’s mom. Child sexual abuse was committed due to economic reasons. The perpetrator was promised for granted amount of money if she make a video with her son. As a parent, mother should protect her child. The Convention on Right of the Child give a special right for parents in represent their child right’s. Aims. This research aims to find out pertain to child sexual abuse committed by parents under the CRC, and the implementation for doing preventive and remedy measures of sexual abuse in digital platform based on CRC. Method. This research conducted by using normative research through analyze international legal instruments, theory, and domestic law comparison in relation with child sexual abuse in digital platform. Results. This research found that (1) although parents can to represents their child consent, and have ability for making decision for their child, however, this right is limited. When parents are inable to protect or threat their child, therefore, state has duty to protect those children. (2) The state may to doing preventive measures by track the sensitive content, especially for application that already contain that, and state must to erase the content or related to the contain that contain child, especially when they are get sexually abused. Therefore, state has an important role to protect, fulfill, and respect children rights under the CRC.
