Abstract (Abstrak)
ANDI MAYZHARAH AMALIA FAISAL (B011191388) “Contract Group Band As An Agreement Between Personnel Band In Indonesia”. Supervised by Oky Deviany as main supervisor and Fadilla Jamila as Co-Supervisor. Background: This study explores the role of the Gentlementt Agreement as the basis for an agreement between band personnel in Indonesia, based on the principle of good faith. It also addresses the urgency of regulating and applying a written contract group band as an agreement between band personnel. Objectives: This study aims to analyze the effectiveness of Gentlementt Agreements and the necessity of written contracts for group band personnel in Indonesia based on the principles of contract law. Method: The research adopts an empirical method, utilizing primary data derived from interviews (field studies) and secondary data sourced from legislation and literature (library research). The study is qualitatively analyzed and presented descriptively. Results: The study shows that (1) Gentlementt Agreements, while serving as the foundational framework for agreements among band personnel in Indonesia, encounter challenges in legal enforcement due to their informal nature despite fulfilling the requirements of Articles 1320 and 1338 of the Indonesian Civil Code. (2) The urgency of implementing written contracts among Indonesian band personnel has become evident, with recurring conflicts and band dissolutions highlighting the need for formal agreements that provide legal certainty and safeguard against potential disputes. Conclusion: Written contracts are essential for regulating key aspects such as profit sharing, band name usage, personnel replacement, and asset ownership. These contracts serve as a preventive legal measure to mitigate conflicts and allow bands to focus on their creative efforts, as demonstrated by conflicts in popular Indonesian bands.
