Abstract (Abstrak)

SALMAWATI ANUGRAH B011191131, with title "Judicial Analysis of Criminal Acts of Providers of Fish Shooting Gambling Facilities (Case Study of Decision Number 1310/Pid.B/2020/PN Mdn)". Supervised by Abdul Azis and Syarif Saddam Rivanie.
This research aims to determine the qualifications of criminal acts providing fish shooting gambling facilities from a criminal law perspective and to analyze the legal considerations of the panel of judges in sentencing providers of fish shooting gambling facilities in Decision Number: 1310/Pid.B/2020/PN. Mdn.
This research uses a type of normative legal research using a statutory approach and a case approach. The legal materials used are primary materials and secondary legal materials. Legal materials are analyzed using prescription analysis.
The results of this research are (1) The qualification of the criminal act of gambling committed by the defendant from a criminal law perspective, namely the criminal act of providing fish shooting gambling facilities as regulated in Article 303 Paragraph (1) 2 of the Criminal Code, which is a formal offense and can be imposed on anyone. who commits acts that are prohibited by statutory provisions, such as the defendant only offering or giving the public the opportunity to play gambling by providing a fish shooting game machine so that the defendant's actions are included in crimes against public order which can disturb the public and do not support government programs in eradicate gambling. Apart from that, the defendant used the fish shooting gambling game as a livelihood from the defendant's role as a provider of fish shooting gambling machine facilities, acting as an operator and buying and selling coins in the fish shooting gambling game. Therefore, the defendant can apply Article 303 Paragraph (1) to - 1 Criminal Code. (2) Legal consideration by the Panel of Judges regarding the criminal sanctions given by the defendant to imprisonment for 1 (one) year and 6 (six) months. Based on the subsidiary indictment of Article 303 Paragraph (1) 2 of the Criminal Code, he has been legally and convincingly proven guilty and fulfills all the elements contained in Article 303 Paragraph (1) 2 of the Criminal Code. However, the author does not fully agree with the reasons in the judge's consideration of the defendant. provided 2 (two) fish shooting gambling game machines and also acted as an operator in the fish shooting gambling game so that for this reason the defendant received a profit (wages) from the shooting gambling game every month of 20%. So the charges that are proven should be the Primair charges, namely Article 303 Paragraph (1) 1 of the Criminal Code.
