This study aims to analyze the qualifications of non-physical sexual
harassment crimes and the qualifications of non-physical sexual
harassment using certain objects.
This study uses a normative legal research method with a statutory
approach and a conceptual approach. Types and sources of legal materials
used are primary, secondary and tertiary legal materials. Then the analysis
technique used is a qualitative method.
The results of this study are: 1. The qualification for the crime of
non-physical sexual harassment is regulated in various laws and
regulations, especially in Article 5 of the TPKS Law and is a complaint
offense. 2. The qualification for the crime of non-physical sexual harassment
using a certain object is based on a case study where the perpetrators of
DD and KH who had committed non-physical sexual harassment by peeking
at the victim by operating CCTV fulfilled the elements of Article 5 of the
TPKS Law, but based on the case above where the perpetrators use CCTV
objects which are part of the information system, so that in the TPKS Law
there are articles that more specifically regulate Electronic-Based Sexual
Violence, namely Article 14 paragraph (1) letter a.
