Abstract (Abstrak)

Penelitian ini bertujuan untuk menganalisis dan menjelaskan kesesuaian antara putusan MK dengan Surat Keputusan KPK terkait pengalihan status pegawai KPK menjadi ASN serta pengalahgunaan wewenang Pimpinan KPK terhadap pengalihan status pegawai KPK menjadi ASN.
Tipe penelitian yang digunakan penulis adalah tipe penelitian hukum normatif dengan metode pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum yang digunakan terdiri atas bahan hukum primer, serta bahan hukum sekunder keseluruhan bahan hukum tersebut dianalisis secara kualitatif dan disajikan secara deskriptif.
Adapun hasil penelitian ini, yaitu 1) Keputusan Ketua KPK secara terang benderang menimbulkan ketidaksesuaian dengan putusan MK karena KPK tidak menjalankan isi dari putusan tersebut dengan mengeluarkan SK terkait pemberhentian dengan hormat pegawai KPK. Terdapat 18 dari 75 pegawai KPK diangkat menjadi ASN dan 57 pegawai diberhentikan dengan hormat menjadi pegawai KPK. Hal ini menimbulkan kerugian bagi pegawai dikarenakan diberhentikan menjadi pegawai KPK. Dalam pengalihan pegawai KPK menjadi ASN seharusnya hanya diubah kedudukannya yang lama menjadi yang baru tidak untuk dibebas tugaskan atau di nonaktfikan ataupun diberhentikan. Sehingga penulis menyimpulkan dalam Surat Keputusan yang dikeluarkan oleh Pimpinan KPK bertentangan dengan Putusan MK Nomor 70/PUU-XVII/2019. 2) Pada uraikan Pasal 18 dan 19 PP 63 2005 bahwa benar Pimpinan KPK memiliki kewenangan untuk memberhentikan pegawai KPK. Namun, tidak terdapat satu pun klausul yang memperbolehkan Pimpinan KPK memberhentikan pegawai KPK yang TMS in casu tidak lolos TWK. Sehingga penulis menyimpulkan Pimpinan KPK telah melampaui wewenang yang diberikan PP 63 2005 dalam hal memberhentikan 57 pegawai KPK.

ABSTRACT

EGY OKTAVIAN PRANATA (B021171502) BY TITLE “JURIDICAL REVIEW OF ARRANGEMENTS FOR TRANSFERRING THE STATUS OF KPK EMPLOYEES TO ASN”. Under the guidance of (Marten Arie) as Main Advisor and (Fajlurrahman) as Companion Advisor.
This study aims to analyze and explain the suitability between the Constitutional Court's decision and the KPK Decree regarding the transfer of the status of KPK employees to ASN and the abuse of authority of the KPK leadership towards the transfer of the status of KPK employees to ASN.
The type of research used by the author is a normative legal research type with a statutory approach and a case approach. The legal materials used consist of primary legal materials, as well as secondary legal materials. All of these legal materials are analyzed qualitatively and presented descriptively.
The results of this study, namely 1) The decision of the Chairman of the Corruption Eradication Commission clearly caused a discrepancy with the Constitutional Court's decision because the KPK did not carry out the contents of the decision by issuing a decree related to the honorable dismissal of KPK employees. There were 18 of 75 KPK employees who were appointed as ASN and 57 employees were honorably dismissed as KPK employees. This causes losses for employees because they are dismissed as KPK employees. In the transfer of KPK employees to ASN, the old position should only be changed to a new one, not to be released from duty or inactivated or dismissed. So the author concludes that the Decree issued by the KPK leadership contradicts the Constitutional Court's Decision Number 70/PUU-XVII/2019. 2) As described in Articles 18 and 19 of PP 63 2005, it is true that the KPK leadership has the authority to dismiss KPK employees. However, there is not a single clause that allows the KPK leadership to dismiss KPK employees whose TMS in casu does not pass the TWK. So the author concludes that the KPK leadership has exceeded the authority given by PP 63 2005 in terms of dismissing 57 KPK employees.
